RTI TO GUJRAT PUBLIC SERVICE COMMISSION, AND ITS REPLY STATING THAT GPSC DO PROVIDE CERTIFIED XEROX COPIES TO THE CANDIDATES, AND MODERATION DOES NOT HELD IN GPSC. WHENEVER SCALING IS DONE, CANDIDATES ARE MADE AWARE OF. THERE IS NO CASE PENDING AGAINST GPSC REGARDING THE RTI ACT 2005..... THATS CALLED TRANSPARENCE

1-     Please tell the view of the commission with respect to disclosure of evaluated answer sheets under RTI as now it falls under the expanded definition of “information” under RTI Act, after SC judgment of August 2011 in Central Board of Secondary Education (CBSE) & Anr. Vs. Aditya Bandopadhyay & Ors case.
2-     Whether or not the commission has so far complied with the above judgment and is releasing photocopies of the evaluated answer sheets under RTI and allowing candidates to inspect their evaluated answer sheets? If not, please give the reasons and the basis on which it is enabled to do so. If yes, then please give the details of such RTI applications received so far with action taken thereof.
3-     Whether any communication took place between your commission and UPSC on this matter and what was the UPSC’s response? Please give the photocopy of the related documents with file noting.
4-     Whether moderation/scaling is done by your commission in examinations conducted by it. If yes, then please give the details of the same process.
5-     Please tell whether your commission is involved in any court case on the issue of evaluated answer sheets’ disclosure under RTI or not? If yes, then please give the details like grounds, prayer etc. of the same with case number and type, court name, diary number, present status etc. If possible, then also provide the photocopy of the related case documents available with the commission.
D- If any of the above information cannot be provided, wholly or partially, then please cite the detailed and clear reasons and detailed rules which enable your office to do so.

                With reference to your application dated 26/06/2012 to get information under Right to Information Act 2005, (I.D. no 2217 Dated 07/07/2012), after investigation, the point wise details of the information sought by you are as follow:
Point 1 & 2: the commission provides the certified Xerox copies to the candidates and also calls them for the inspection of their copies.
Point 3: in this respect, no correspondence has been done with UPSC.
Point 4: the Commission does not apply moderation in its copies, and when scaling is applied, the candidates are duly informed.
Point 5: There is no court case pending in any court regarding providing of certified copies to the candidates under RTI Act 2005.  

If you are not satisfied with the above given information, then you can further appeal within 30 days of this letter to Mr. M.A. BHATT, SECRETARY, GUJRAT PUBLIC SERVICE COMMISSION, FIRST FLOOR, MULTISTORYED BUILDING, LAL DARWAJA, AHMEDABAD – 1.
